These terms are a contract between you and Emil Rustamzade Valeh oglu, individual entrepreneur (VÖEN 1007379292, Republic of Azerbaijan), who owns and operates the game Founday. Below, "we".
By installing or using the app you accept these terms. If you do not accept them, do not use the app.
How we handle data is described separately in the Privacy Policy, and what you may and may not photograph is in the Community Guidelines. Both documents form part of these terms.
Founday is a photo game about attention. You pick a journey — a short series of photo tasks about ordinary life, such as "your cup" or "light you like" — and answer each step with a photo, taken with the app's camera or picked from your gallery. Steps can be shot in any order and at your own pace: there are no deadlines, streaks, scores or ratings, and a journey waits for you as long as it takes. When every step is shot, your shots are assembled into a postcard that stays on your shelf, and you can share it if you want to.
The game is free. It has no subscription, no in-app purchases and no ads. If paid features appear one day, they will be sold through the app store, and their terms will be added here before they appear.
You keep the rights to your photos and captions. We do not become their owner.
By adding a photo or a caption to Founday you grant us a non-exclusive, worldwide, royalty-free permission (licence) to use it solely to operate the service for you, namely to:
The permission ends when the photo is removed from the service — when you replace it, cancel its journey or delete the account. Copies in backups are overwritten over time (see section 8 of the Privacy Policy).
What we will not do: show your photos to other people, sell them, place them in stock libraries, pass them to third parties for their own purposes, or use them in advertising. If we ever want to use a specific photo beyond the list above — in material about the game itself, for example — we will ask you separately.
By adding a photo you confirm that you are entitled to: you took it yourself or may use it, it infringes no one's rights, and it contains nothing prohibited by the Community Guidelines.
A postcard combines your photos and words with our design: the shape, paper and layout of the card, the journey's title and the Founday mark. You may share your postcards freely for personal, non-commercial purposes — in messages, in stories, on paper.
A postcard leaves the app only when you tap Share, and you choose where it goes. After that it is in the hands of the people and services you sent it to; we cannot call it back, and what those services do with it is governed by their own rules. Before sharing, think about the people who may be in your shots.
Journeys, task texts, covers, postcard designs and the look of the app belong to us or to those who licensed them to us. You may use them inside the app and share them as part of your own postcards.
We may add, change and retire journeys. A journey you have already started keeps its set of steps until you finish it, whatever we change in it meanwhile.
You may not:
In response to a violation we may close the account — proportionately to how serious and how repeated the violation is, and where possible after a warning. For illegal content we act at once.
While playing, obey the law and common sense: do not enter restricted areas, do not break traffic rules, do not photograph where photography is prohibited, and do not take risks for a shot. Where and how you shoot is your responsibility.
The game is provided "as is". To the extent permitted by applicable law we make no warranty of uninterrupted or error-free operation, and we are not liable for indirect losses, lost profit or data loss that is not our fault.
Nothing in this section limits liability that cannot be limited by law: intent and gross negligence, harm to life and health, and consumer rights granted by the mandatory rules of your country of residence.
These terms are governed by the law of the Republic of Azerbaijan. If you are a consumer resident elsewhere, you keep the rights granted to you by the mandatory rules of your own country — this clause does not remove them, and you may also bring proceedings where you live.
Before going to court, write to [email protected]: most disputes are settled by email.
We may change these terms. The date and version at the top of this page change with them. If you do not agree with the new version you may delete your account; continuing to play means you accept it.
