Terms of Use

In short
- Your photos stay yours. We get permission to show them inside the game — nothing more.
- We do not sell photos and do not place them in stock libraries.
- 13+, one person one account, photos only from the built-in camera.
- If the automated check gets it wrong, appeal: someone else's mistake must not burn your streak.
- The Founday Infinite subscription is sold through Google Play and cancelled there too.
1. What this agreement is
These terms are a contract between you and Emil Rustamzade Valeh oglu,
individual entrepreneur (VÖEN 1007379292, Republic of Azerbaijan), who owns and
operates the game Founday. Below, "we".
By installing or using the app you accept these terms. If you do not accept
them, do not use the app.
How we handle data is described separately in the
Privacy Policy, and what you may and may not photograph is
in the Community Guidelines. Both documents form part of
these terms.
2. What Founday is
Founday is a game in which the whole world receives the same photo task once a
day. You find the object in the real world, photograph it with the app's built-in
camera, and an automated check decides whether the task is completed. Credited
finds build up into a collection, a streak and a shared feed.
The game is provided free of charge. Certain additional features may be part
of a paid subscription (section 8).
3. Who may play
- You are at least 13 years old. We ask for a date of birth at sign-up.
- If you live in an EU country where processing children's data requires a higher age (13 to 16 depending on the country) and you are below it, you need the consent of a parent or legal guardian.
- You are not subject to a block we imposed earlier.
4. Your account
- One person, one account. Creating several accounts to gain an advantage in the game is not allowed.
- You are responsible for keeping your password safe and for what happens under your account. If you notice a sign-in that is not yours, end that session in settings and change your password.
- Your @handle is visible to other players. Handles that impersonate someone, insult, or infringe others' rights may be changed or blocked by us.
- Accounts may not be transferred, sold or rented out.
5. Fair play
The point of the game is to find a real object in the real world. Therefore:
- photos are taken with the app's built-in camera only; uploading existing images is not supported, and attempts to work around this are a violation;
- you may not photograph someone else's photo, a screen, a print or a poster and pass it off as a find;
- you may not present another player's find as your own;
- you may not use generated or edited images;
- you may not interfere with the app or the server, circumvent limits, automate play, or load the service with artificial requests.
In response to a violation we may withdraw the credit, hide the find, restrict
publication or block the account — proportionately to how serious and how
repeated the violation is.
6. Your photos and the rights to them
You keep the rights to the photos you take. We do not become their
owner.
By publishing a find you grant us a non-exclusive, worldwide, royalty-free
permission (licence) to use that photo solely to operate the service,
namely to:
- show it in the day's shared feed, in the archive of past days, and in your collection;
- show it to other players in rankings and on day cards;
- build the shareable card that you yourself create from it;
- store copies on our servers, in the content-delivery cache and in backups;
- process it automatically for task checking and moderation.
The permission ends when the photo is removed from the service — when you
delete the find or the account. Backups and caches clear within a reasonable
technical period (see section 7 of the Privacy Policy).
What we will not do: sell your photos, place them in stock libraries,
pass them to third parties for their own purposes, or use them in third-party
advertising. If we ever want to use a specific photo beyond the list above — in
material about the game itself, for example — we will ask you separately.
By publishing a photo you confirm that you are entitled to: you took it, it
infringes no one's rights, and it contains nothing prohibited by the
Community Guidelines.
7. Checking, moderation and appeals
- Photos are checked automatically. The check is tuned in the player's favour: when in doubt, the task is credited.
- Credit and publication are separate events. If a photo raised a moderation doubt it may not reach the shared feed, while the credit and your streak remain intact.
- If you disagree with a rejection, use the appeal button: the case goes to review, and your streak holds while the review is open.
- Every photo in the feed can be reported, and any player can be hidden from your feed.
- Repeat violations lead to the consequences set out in the Community Guidelines: from a warning to a publishing ban and account blocking.
8. The Founday Infinite subscription
Some features may be offered through the paid Founday Infinite
subscription, on these terms:
- The subscription is sold through Google Play. Google is the seller under its own terms and takes the payment; we do not take it directly.
- The current price, period and contents of the subscription are shown in the app before payment. Prices may differ by country.
- The subscription renews automatically at the end of each paid period until you cancel it.
- Cancelling is done in Google Play (Subscriptions → Founday → Cancel). Cancelling stops future charges; the period already paid for runs to its end.
- Refunds follow Google Play's rules and the consumer law of your country. Where a refund is required by consumer law, it will be made.
- The contents of the subscription may change. If a change materially reduces what you paid for, we will warn you in advance and you may cancel.
- Game achievements — streaks, finds, ranking positions, freezes — are not money or property, have no monetary value, cannot be exchanged for money and cannot be transferred between accounts.
- The subscription may be unavailable in some countries or switched off entirely, in which case the game is fully free.
9. Availability and changes
- We do our best to keep the game running, but we do not promise the complete absence of outages, maintenance windows and bugs.
- We may change, add and remove features, including game mechanics and task rules.
- We may suspend or discontinue the service. If we discontinue it permanently on our own initiative, we will warn you in advance so that you can retrieve your photos.
10. Ending the agreement
- You may leave at any time: delete your account in the app's settings — see the instructions.
- We may restrict or close an account for a material or repeated breach of these terms or the Community Guidelines, or where the law requires it. We aim to act proportionately and, where possible, to warn first.
- A full ban from the game is a last resort. Restrictions normally apply to publishing, not to playing.
11. Warranties and liability
The game is provided "as is". To the extent permitted by applicable law we make
no warranty of uninterrupted or error-free operation, and we are not liable for
indirect losses, lost profit or data loss that is not our fault.
Nothing in this section limits liability that cannot be limited by law:
intent and gross negligence, harm to life and health, and consumer rights granted
by the mandatory rules of your country of residence.
Safety beats the find. While playing, obey the law and common sense: do
not enter restricted areas, do not break traffic rules, do not photograph where
photography is prohibited, and do not take risks for a shot. Where and how you
shoot is your responsibility.
12. Governing law and disputes
These terms are governed by the law of the Republic of Azerbaijan. If you are a
consumer resident elsewhere, you keep the rights granted to you by the mandatory
rules of your own country — this clause does not remove them, and you may also
bring proceedings where you live.

13. Changes to these terms
We may change these terms. We will announce material changes in the app or by
email before they take effect. If you do not agree with the new version you may
delete your account; continuing to play means you accept it.
